Terms and Conditions

1. Scope and contracting parties
These terms govern all contracts concluded via protocol.atlasbiolabs.com between Atlas Life Sciences GmbH ("Atlas Life Sciences", "we") and consumers ("customer", "you") per §13 BGB.
2. Services offered
Atlas Baseline: whole genome sequencing analysis from a saliva or blood sample, AI-interpreted report, and optional pre-test genetic counseling.
Atlas Trace: epigenetic methylation analysis from a blood sample, structured reports on biological age, stress signatures, hair health, and athletic recovery.
Both services include: kit shipping, laboratory analysis, and structured reporting.
3. Conclusion of contract
A contract is formed when you complete checkout via our payment provider (Stripe). You receive an order confirmation via email.
4. Prices and payment
All prices are in EUR and include VAT.
Payment is processed via Stripe (credit card, SEPA, and other methods offered at checkout).
Payment is processed at checkout. Invoices are issued electronically.
5. Delivery
The sample collection kit is shipped to the address provided at checkout.
Delivery within 5-7 business days within the EU and UK.
Geographic scope: EU and UK only. Shipping is included in the price.
6. Sample processing and results delivery
The customer collects the sample per the included instructions and returns it via the prepaid return shipping label.
Laboratory processing: 4-6 weeks from sample receipt.
Results are delivered via secure email or through the customer portal.
7. Withdrawal right (§312g BGB)
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day you receive the sample collection kit.
To exercise the right of withdrawal, you must inform us (Atlas Life Sciences GmbH, Aroser Allee 68, 13407 Berlin, hello@atlasbiolabs.com) of your decision to withdraw from this contract by a clear statement (e.g., a letter sent by post or email).
Upon valid withdrawal, we refund all payments received from you without undue delay and no later than 14 days from the day we receive your withdrawal notice.
Important: the right of withdrawal expires prematurely once the laboratory has begun processing your sample (i.e., once your returned sample has been registered at our laboratory and analysis has commenced). By activating or using the collection kit and returning the sample for processing, you explicitly consent to the commencement of services within the withdrawal period and acknowledge that your right of withdrawal expires upon commencement of analysis per §356(4) BGB.
8. Medical disclaimer and service scope
Atlas Protocol provides informational and decision-support services. Results are not a medical diagnosis. Results should be discussed with a qualified healthcare provider before making medical decisions. Atlas Life Sciences GmbH does not replace medical care.
9. GenDG compliance (Baseline only)
Atlas Baseline is a predictive genetic analysis subject to the German Genetic Diagnostics Act (GenDG). Before ordering, you must actively choose between:
- (a) Pre-test genetic counseling with our medical geneticist, or
- (b) A written waiver of pre-test counseling per §10 GenDG.
Post-test genetic counseling is available at any time upon request.
10. Age and geographic restrictions
Customers must be 18 years of age or older.
The service is available in EU member states and the United Kingdom only.
11. Warranty (consumer)
Statutory warranty provisions apply (§§434 ff. BGB). The warranty period is 2 years for material defects. Claims must be reported to hello@atlasbiolabs.com.
12. Liability
Atlas Life Sciences GmbH is liable without limitation for intent and gross negligence, for injury to life, body, or health, and under the German Product Liability Act.
For slight negligence, liability is limited to breach of essential contractual obligations (obligations whose fulfillment is essential to the proper performance of the contract and on whose fulfillment the customer regularly relies), and capped at foreseeable damages typical for this type of contract.
Liability for consequential damages is excluded except where mandatory by law.
Atlas Life Sciences GmbH assumes no liability for medical or lifestyle decisions made by the customer based on Atlas Protocol results.
13. Applicable law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the protective jurisdiction of the consumer's habitual residence remains unaffected. For merchant-level disputes where applicable, jurisdiction is Berlin.
14. Severability
Should any provision of these terms be invalid, the remaining provisions remain unaffected. The parties agree to replace the invalid provision with a valid provision closest to the original economic intent.
15. Data protection
For personal data processing, our Privacy Policy applies: protocol.atlasbiolabs.com/privacy.
16. Contract language
These terms are available in English and German. In case of inconsistency, the German version prevails.
